The rules governing access to and use of exloader.app and the ExLoader
application.
##Acceptance of these terms
These Terms of Use govern the exloader.app website and the ExLoader application and
services (together, the "Site"), operated by SwiftSoft LLC ("we," "us," "ExLoader"). By using the
Site, you accept these conditions in full. If you disagree with any part of them, do not use the
Site.
##Changes to these terms
We reserve the right to change these terms at any time. When we do, we will revise the
date at the bottom of this page, so please check for changes each time you use the Site. It is your
responsibility to review this document periodically. Continued use of the Site after changes are
posted will be treated as acceptance of those changes.
##Registration, access restrictions, and
minimum age
Interactive use of the Site is limited to registered accounts, in line with these Terms
of Use and our community rules. Certain features may be unavailable to guests, unconfirmed accounts,
or newly registered accounts until required verification or approval steps are complete.
The Site is a general-audience technical platform and is not directed at children. You
must be at least 13 years old to register for and use an account. During registration, users must
provide age information, and accounts that do not meet this minimum cannot be created. By
registering, you confirm that you meet this requirement and that the information you provide is
accurate. ExLoader reserves the right to restrict, suspend, or terminate accounts that do not comply
with these requirements.
While the Site is not directed at children, we recognize it may be accessed by a general
audience, and we apply moderation, content controls, and safety measures accordingly.
Use of the Site is also subject to the Community Rules, as well as any Downloads section
rules, documentation or wiki rules, and other section-specific guidelines published by ExLoader from
time to time. Those rules form part of these Terms of Use and are incorporated by reference. Where a
section-specific rule conflicts with these Terms of Use, ExLoader may determine which provision
applies.
##License and restrictions
ExLoader grants you a personal, limited, non-transferable, and revocable license to
access and use the Site and its services for non-commercial purposes, subject to your compliance
with these Terms of Use. All materials found on the Site, including but not limited to user
accounts, images, text, and files, are owned or licensed by ExLoader and are protected by applicable
copyright and intellectual property laws.
– You may view, post, and download from the Site only for non-commercial purposes.
– You may not post material from the Site on another website or computer network without
our written permission.
– You may not transmit or distribute material from the Site to other websites without
our written permission.
– You may not use the Site or information found on it to sell or promote products or
services, solicit clients, or for any other commercial purpose.
– You may not engage in automated scraping, harvesting, data mining, or redistribution
of Site content without our prior written permission.
Notwithstanding the foregoing, ExLoader reserves the right, at its sole discretion, to
deny access, revoke licenses, or limit use of the Site, including reproduction of Site content. It
is not the responsibility of ExLoader to determine whether a particular use of Site materials
qualifies as fair use or a similar legal exception; that determination remains solely the
responsibility of the user. ExLoader reserves the right to act on its own assessment of the use of
Site content, regardless of any claim of fair use.
##Automated access and scraping
Automated scraping, harvesting, or data mining of the Site or its content is strictly
prohibited without our prior written permission. This includes, without limitation, the use of bots,
spiders, crawlers, or similar tools to access, query, copy, or archive content. You also agree not
to bypass or attempt to bypass any technical protections, including authentication, rate limiting,
CAPTCHAs, IP blocks, or signed links. Use of the Site must be limited to interactive, human-driven
browsing as intended.
##Code of conduct
You agree that you will not, individually or as part of any collective effort, submit or
post information to the Site that could be deemed harmful or illegal, nor will you impersonate
another user to hide your identity or implicate another in such actions. You agree not to disrupt
the flow of data to and from the Site, impact its service or performance, or circumvent any controls
or usage rules we have implemented. Harmful or illegal actions may result in revocation of your
right to use the Site, and legal action may be taken against you. You further agree not to use
automated means to access, query, or download from the Site, nor to attempt to evade or defeat any
technical measures we employ.
##Illegal content and user safety
ExLoader does not permit use of the Site for illegal content or unlawful activity. Users
must not post, upload, transmit, request, distribute, store, link to, or otherwise make available
any content that is illegal, facilitates illegal activity, or is otherwise prohibited by applicable
law or these Terms of Use.
For the purposes of these Terms of Use, "illegal content" includes content that amounts
to, assists, encourages, or facilitates a criminal offence or unlawful act, including, where
applicable, content relating to terrorism, child sexual exploitation or abuse, malware, credential
theft, fraud, unlawful circumvention, unlawful threats or harassment, unlawful hate material,
unlawful pornography, unlawful disclosure of personal data, and other unlawful or prohibited
material. This description is illustrative and non-exhaustive.
ExLoader uses a combination of technical measures, account restrictions, manual review,
content moderation, reporting tools, and staff policies to help protect individuals from illegal
content, including, where appropriate: restricting interactive use to registered and confirmed
accounts; requiring email confirmation before certain features become available; placing new
accounts into a moderated approval state for initial posts; restricting private messaging until
initial activity has been reviewed; applying content moderation to posts, threads, profiles, file
uploads, private messages, and other user-generated content; reviewing reported content and taking
action where appropriate, including edits, removal, restriction, warnings, infractions, suspension,
or bans; and giving priority review to content that appears to involve illegality, safety risks, or
malware.
ExLoader may remove, restrict, disable access to, investigate, preserve, or disclose
content or account information where appropriate to enforce these Terms of Use, protect users,
investigate abuse, comply with applicable law, respond to legal process, or protect the Site, its
users, or third parties.
##Proactive technology and anti-abuse
measures
ExLoader uses proportionate proactive and preventative measures to help detect, limit,
and address spam, abuse, and prohibited content, including automated spam detection, word filters,
anti-abuse rules, external-link filtering, and rate limiting for posts, threads, and messages, as
well as technical restrictions on unconfirmed or newly registered accounts. ExLoader may update,
expand, reduce, or refine these measures at any time without notice for security, moderation, legal
compliance, or operational reasons.
##Reporting content and complaints
ExLoader provides reporting functionality for user-generated content where available,
including posts, threads, and private messages. Users should use the built-in report function where
available to notify staff of content that may violate these Terms of Use, our rules, or applicable
law.
General moderation or content complaints may be sent via the in-Site messaging system,
or by emailing help@swiftsoft.llc. Copyright
complaints and DMCA notices must be sent to the same address with "DMCA" in the subject line, in
accordance with the DMCA and Copyright Infringement section below.
Reports and complaints are reviewed manually by staff. ExLoader aims to handle reports
as soon as reasonably practicable. Content that appears to involve illegality, malware, or
significant safety risk may be prioritized for expedited review.
##Moderation, enforcement, and appeals
ExLoader uses volunteer moderators, administrators, and section-specific staff,
including Downloads moderators, to review content, reports, and account activity. Moderation
decisions follow manual review and investigation, which may include review of account history,
associated content, and technical or safety analysis of submitted files where relevant.
ExLoader may take enforcement action where content or conduct violates these Terms of
Use, our rules, applicable law, or the safety and integrity of the Site. Enforcement may include
content edits or removal, warnings, infractions, temporary or permanent bans, feature restrictions,
or other proportionate measures, with or without prior notice where appropriate.
Users may appeal moderation or enforcement decisions, including bans and content
actions, by emailing help@swiftsoft.llc with
"Appeal" in the subject line. Appeal decisions may be reviewed by additional staff to help ensure
the original decision was appropriate.
##Licenses you are granting this site
By submitting or posting your lawful content to the Site, either directly or through a
third-party service, you grant the Site a royalty-free, perpetual, irrevocable, non-exclusive
(subject to the limitations below), sublicensable, assignable, worldwide license to use your
content, together with all necessary consents or waivers, to distribute, publicly perform, publicly
display, transmit, communicate to the public, and modify your content, by any means and in any media
format or channel now known or later devised, and to advertise and promote such use, without further
notice to, or compensation for, you or any other person.
##Limitations on non-exclusive use
Unless you grant explicit written permission to a third party, the Site retains sole
authority to authorize, restrict, or permit any further use or distribution of the licensed material
by others.
##DMCA and copyright infringement
ExLoader is a user-generated content platform that allows discussion of programming,
reverse engineering, security research, and related technical topics. We do not knowingly host or
permit the posting of content that infringes copyright or violates anti-circumvention laws.
In accordance with the Digital Millennium Copyright Act (DMCA), ExLoader responds to
valid takedown notices submitted under 17 U.S.C. §512. Upon receipt of a compliant notification, the
identified material will be reviewed and removed or disabled in a timely manner if the notice
complies with the statutory requirements of the DMCA.
As a platform hosting user submissions, ExLoader cannot pre-screen all content. We
maintain clear rules prohibiting the posting of anti-cheat bypasses, circumvention tools, and
similar material; content that violates our rules or applicable law is removed when detected; and
content subject to a valid DMCA request is removed in accordance with the statute.
If you believe material on the Site infringes your copyright or circumvents a
technological protection measure, you may submit a DMCA notice to help@swiftsoft.llc
with "DMCA" in the subject line. Your notice must comply with the formal requirements of the DMCA,
including proper identification of the copyrighted work and the infringing material, and must
include:
– A description of the copyrighted work you claim has been infringed.
– A description of the material you claim is infringing, including the URL of the
material you want removed or disabled.
– Your full legal name, title (if acting on behalf of the copyright owner), physical
mailing address, telephone number, and email address.
– A statement that you have a good faith belief the use described is not authorized by
the copyright owner, its agent, or the law.
– A statement, under penalty of perjury, that the information in the notice is accurate
and that you are the owner, or authorized to act on behalf of the owner, of the exclusive right
allegedly infringed.
– Your electronic or physical signature; typing your full legal name satisfies this
requirement if submitting electronically.
ExLoader reserves the right to request additional information, including
government-issued identification, if necessary to verify a DMCA notice or comply with applicable
law. Knowingly submitting a false DMCA notice is a violation of U.S. law (17 U.S.C. §512(f)) and may
expose the sender to legal liability, including damages. ExLoader reserves the right to suspend or
terminate accounts that repeatedly violate copyright or anti-circumvention rules, in accordance with
our repeat-infringer policy.
##Counter-notification
If you believe material you posted was removed or disabled in error or through
misidentification, you may submit a counter-notification under 17 U.S.C. §512(g) to help@swiftsoft.llc with "Counter-Notice"
in the subject line. A valid counter-notification must include identification of the removed
material and where it appeared; a statement under penalty of perjury that you have a good faith
belief the material was removed by mistake or misidentification; your full legal name, physical
mailing address, telephone number, and email address; a statement consenting to the jurisdiction of
the applicable federal district court and accepting service of process from the original notifying
party; and your physical or electronic signature.
If we receive a valid counter-notification, we will forward it to the party who
submitted the original DMCA notice. If that party does not notify us within the statutory period
that they have filed a court action, the removed material will generally be restored between 10 and
14 business days after receipt of the valid counter-notification, in accordance with 17 U.S.C.
§512(g).
##Linking
For your convenience, the Site may contain links to websites operated by others. These
sites are not maintained or controlled by us, and we are not responsible for their content. Although
we make a good-faith effort to link only to appropriate websites, some may contain inappropriate or
objectionable material; if you encounter such material, please notify us. We believe that
information made available on the internet is generally expected to be publicly and widely
accessible, and that linking to other websites is consistent with that expectation. If access to a
particular website should be restricted, the operator should promptly notify us.
##Disclaimers and warranties
Materials on this Site relating to reverse engineering are provided for educational
purposes and for purposes consistent with interoperability as contemplated by 17 U.S.C. §1201(f) and
EU Directive 2009/24/EC. The Site does not control user-submitted content and is not responsible for
how any third party may use such materials.
Users of the Site are fully responsible for any consequences resulting from their
use of the Site. Information on the Site is provided for educational or informational purposes
only.
The materials on the Site and any linked website are provided "as is" and without
warranties of any kind, express or implied. To the fullest extent permitted by applicable law, we
disclaim all warranties, including warranties of title, merchantability, and fitness for a
particular purpose. We do not warrant that the Site will operate uninterrupted or error-free, that
defects will be corrected, or that the Site or its servers are free of harmful components.
##Limitation of liability
We are not liable for any consequential or special damages resulting from your use of,
or inability to use, the materials on the Site or any linked website, including lost profits,
business interruption, or loss of data. In no event shall our total liability to you for all
damages, losses, and causes of action exceed the amount you paid, if any, for accessing the
Site.
##Jurisdiction and applicable law
This Agreement is governed by and construed in accordance with the laws of the
jurisdiction in which the Site operator is established, without regard to conflict-of-law
principles. Subject to any mandatory consumer protection laws that may apply, any dispute arising
out of or relating to this Agreement, the Site, or your use of it shall be brought exclusively in
the competent courts of the Site operator's principal place of business, and you consent to the
personal jurisdiction and venue of those courts. Nothing in this section limits our right to seek
injunctive, equitable, or emergency relief in any court of competent jurisdiction where necessary to
protect the Site, its users, or its legal rights.
If any provision of this Agreement is found unlawful, void, or unenforceable, that
provision shall be enforced to the maximum extent permitted by law or modified to achieve its
intended effect, and the remaining provisions shall remain in full force and effect.
